1. Agreement to Terms

If you do not agree with these Terms, do not use the Site. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Use of the Website

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

• Attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems
• Use the Site to transmit any malware, viruses, or harmful code
• Engage in any activity that disrupts or interferes with the Site's functionality or performance

3. Products and Purchases

All products listed on the Site are subject to availability. We reserve the right to limit quantities, refuse orders, and discontinue products at any time. Product descriptions, images, specifications, and pricing are provided for informational purposes and are subject to change without notice.

Prices displayed on the Site are in U.S. dollars and do not include applicable taxes unless otherwise stated. You are responsible for any sales tax, use tax, or other taxes applicable to your purchase based on your shipping destination.

By placing an order, you represent that the information you provide is accurate and complete and that you are authorized to use the payment method provided. We reserve the right to cancel any order if we suspect fraud or unauthorized payment activity.

4. Payment Terms

Payment is required at the time of purchase. We accept Visa, Mastercard, American Express, Discover, PayPal, and Shop Pay. Payment is processed securely through our third-party payment processors. We do not store your credit card information on our servers.

For orders paid via financing, the terms and conditions of the financing agreement between you and our financing partner govern your payment obligations.

5. Shipping and Delivery

Shipping terms are described in our Shipping Policy. We provide free standard ground shipping within the continental United States. Expedited and international shipping options are available. Delivery timelines are estimates and are not guaranteed. Risk of loss and title for items purchased on the Site pass to you upon delivery to the carrier.

6. Returns and Refunds

Returns and refunds are governed by our Refund Policy. Hardware may be returned within 30 days of delivery in original, unused condition. Software licenses and subscriptions are non-refundable once activated.

7. Software Licensing

Jaltest diagnostic software is licensed, not sold. Your use of Jaltest software is governed by the end-user license agreement (EULA) provided by Cojali, the software manufacturer. Software licenses are registered to specific hardware devices and are non-transferable. Your annual software subscription provides access to software updates and new vehicle coverage for the subscription period. Unauthorized copying, distribution, reverse engineering, or modification of the software is strictly prohibited.

8. Intellectual Property

All content on the Site — including text, images, logos, graphics, product descriptions, page layouts, and software — is the property of Diesel Truck Diagnostic Tools or our licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written consent.

The Jaltest and Cojali names, logos, and trademarks are the property of Cojali S.L. and are used by Diesel Truck Diagnostic Tools under authorized dealer agreement.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Product warranties are provided by the respective manufacturers (Cojali for Jaltest products) and are subject to the terms of those manufacturer warranties. Diesel Truck Diagnostic Tools does not provide any additional product warranty beyond what is offered by the manufacturer unless explicitly stated in writing.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIESEL TRUCK DIAGNOSTIC TOOLS, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Diesel Truck Diagnostic Tools, its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Minnesota. You consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Diesel Truck Diagnostic Tools regarding your use of the Site and supersede all prior agreements, communications, and understandings, whether written or oral.
